These Terms explain what you can expect from AccessWiser and what we ask of you in return. We have kept them in plain English — if anything is unclear, just ask us.

1. Acceptance of these terms

These Terms and Conditions (“Terms”) are an agreement between you and Access Wiser Inc., a company based in Orlando, Florida (“Access Wiser”, “we”, “us”). They govern your use of this website and of the AccessWiser service. By visiting the site, creating an account, or installing the AccessWiser widget, you agree to these Terms.

If you are using AccessWiser on behalf of a company or another organization, you confirm that you have the authority to accept these Terms for that organization, and “you” then refers to the organization. If you do not agree with these Terms, please do not use the website or the service.

2. Description of the service

AccessWiser is a software-as-a-service product that helps website owners improve the accessibility of their sites. It includes an accessibility widget that you install on your website, an automated accessibility scanner, and a customer dashboard for managing your sites, settings, and subscription.

AccessWiser is designed to help you work toward recognized accessibility standards and applicable accessibility requirements. However, AccessWiser does not guarantee that your website will be fully accessible, that it will comply with any law, regulation, or standard (such as the ADA, the European Accessibility Act, Section 508, or WCAG), or that you will be protected from accessibility-related claims or complaints. Accessibility is an ongoing effort that depends on how your website is built and maintained. Automated tools are one part of that effort and do not replace manual audits, remediation work, or advice from qualified professionals.

3. Accounts and your responsibilities

To use the service you need an account. You agree to provide accurate information when you register and to keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. If you believe your account has been accessed without authorization, notify us promptly.

You may only connect websites to AccessWiser that you own or that you are authorized to manage. You remain responsible for your own website, its content, and its compliance with the laws that apply to you.

4. Plans, billing, and renewals

AccessWiser is offered as a paid subscription, billed either monthly or yearly. The current plans, features, and prices are listed on the pricing page. There are no hidden fees: the price shown for your plan is what you pay, plus any taxes required by law.

  • Automatic renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly, depending on the plan you chose) until you cancel.
  • Price changes. We may change our prices from time to time. If a change affects your subscription, we will give you advance notice, and the new price will apply from your next billing period. If you do not agree with a price change, you can cancel before it takes effect.
  • Free trials. Where a free trial is offered, it converts into a paid subscription at the end of the trial period unless you cancel first.
  • 30-day money-back guarantee. If you are not satisfied, you may request a full refund within 30 days of your first payment for a plan.
  • Cancellation. You can cancel your subscription at any time from your dashboard. Your plan remains active until the end of the billing period you have already paid for, and you will not be charged again after that.

5. Acceptable use

You agree to use the website and the service only for lawful purposes and in line with these Terms. In particular, you agree not to:

  • use the service on a website that hosts unlawful content or in a way that violates any applicable law or the rights of others;
  • copy, modify, reverse engineer, or create derivative works of the service, except where the law expressly permits it;
  • resell, sublicense, or redistribute the service without a separate written agreement with us;
  • interfere with or disrupt the service, probe or test its security without our written permission, or attempt to access accounts or data that are not yours;
  • misrepresent what the service does — for example, by claiming that installing AccessWiser certifies your website as compliant with any law or standard.

We may suspend or limit access to the service if we reasonably believe these rules are being violated.

6. Intellectual property

The AccessWiser software — including the widget, the scanner, the dashboard, and our branding — belongs to Access Wiser Inc. and its licensors. The service is licensed to you, not sold. While your subscription is active, we grant you a limited, non-exclusive, non-transferable license to install and use the widget on the website(s) covered by your plan and to use the dashboard and scanner as intended.

You keep full ownership of your own website and its content. You grant us only the limited rights we need to provide the service — for example, to scan your pages and render the widget on your site. If you send us feedback or suggestions, we may use them to improve the service without any obligation to you.

7. Third-party services

The service relies on third-party providers such as hosting platforms, content delivery networks, and payment processors, and our website may link to third-party sites. Those services are governed by their own terms and privacy policies, and we are not responsible for their content, availability, or practices. Your payment details are handled by our payment processor; we do not store full card numbers on our systems.

8. Disclaimer of warranties

The website and the service are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that using it will make your website compliant with any law, regulation, or standard.

9. Limitation of liability

To the maximum extent permitted by law, Access Wiser Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or related to your use of the website or the service — even if we have been advised that such damages are possible.

To the same extent, our total combined liability for all claims relating to the service is limited to the amount you paid us for the service in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Termination

You may stop using the service and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the service; where reasonably possible, we will give you notice first.

When your subscription ends, your license to use the service ends with it, and you should remove the widget code from your website. Sections of these Terms that by their nature should survive — such as intellectual property, disclaimers, limitation of liability, and governing law — continue to apply after termination.

11. Changes to these terms

We may update these Terms from time to time, for example when we add features or when the law changes. If a change is material, we will give you reasonable notice — such as by email, a notice in the dashboard, or a notice on this website — before it takes effect. The effective date at the top of this page always shows when the current version took effect. If you continue to use the service after a change becomes effective, that means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the service that cannot be resolved informally will be brought exclusively in the state or federal courts located in Orange County, Florida, and both parties consent to the jurisdiction of those courts.
